These Terms and Conditions (“Terms”) govern your use of the website (https://astepabovemb.com), services, and communications provided by A Step Above, LLC (“A Step Above,” “Company,” “we,” “us,” or “our”). By accessing our website, engaging our services, signing a contract or proposal, or providing your contact information for business purposes, you agree to these Terms.


1. SERVICES

A Step Above provides general contracting, construction, remodeling, flooring installation, design-build, and related services in the Myrtle Beach, South Carolina coastal market and surrounding areas. Our services include but are not limited to residential and commercial construction, high-end remodeling, flooring sales and installation, tile work, cabinetry, exterior renovations, and specialty construction projects.

Individual project terms — including scope of work, pricing, payment schedules, warranties, change order procedures, and completion timelines — are governed by the specific contract or proposal executed for each project. These Terms supplement but do not replace individual project agreements.


2. WEBSITE USE

Permitted Use

Our website is provided for informational purposes and to facilitate communication about our services. You may browse the site, view project information, and contact us through available channels.

Prohibited Use

You may not use our website to:

  • Collect or harvest personal information of others
  • Distribute malware, spam, or other harmful content
  • Attempt unauthorized access to any portion of the website or its systems
  • Reproduce, duplicate, or exploit any content for commercial purposes without written permission

Intellectual Property

All content on our website — including text, images, project photos, logos, graphics, and design elements — is the property of A Step Above or its licensors and is protected by applicable copyright and trademark laws. The A Step Above name, logo, and related marks are trademarks of A Step Above, LLC.


3. PROJECT CONTRACTS AND PROPOSALS

Proposals

All proposals and estimates are valid for the period specified in the document (typically 30 days unless otherwise stated). Proposals represent our best assessment of project costs based on available information at the time of preparation. Material prices, subcontractor availability, and other factors may cause actual costs to vary.

Contracts

Work begins only upon execution of a written contract or proposal acceptance by both parties. All contracts are governed by the laws of the State of South Carolina.

Change Orders

Changes to the scope of work after contract execution require a written change order signed by both parties. Change orders may affect the project timeline and total contract value. No additional work will be performed without an approved change order.

Project Documentation

All proposals, estimates, designs, drawings, specifications, and project documents created by A Step Above remain our intellectual property until the associated project contract is fully executed and paid in full.


4. PAYMENT TERMS

General

Payment terms are defined in individual project contracts. Unless otherwise specified:

  • Deposits are due upon contract execution
  • Progress payments are due as specified in the payment schedule
  • Final payment is due upon substantial completion

Late Payment

Past-due invoices may be subject to interest at the rate of 1.5% per month (18% annually) or the maximum rate permitted by South Carolina law, whichever is less.

Mechanic’s Liens

A Step Above reserves all rights under the South Carolina Mechanic’s Lien Law (S.C. Code § 29-5-10 et seq.) for nonpayment. In the event of nonpayment, we may file a mechanic’s lien against the improved property and pursue all available legal remedies.

Collections

In the event that collection efforts become necessary, you agree to pay all reasonable costs of collection including attorney’s fees, court costs, and filing fees.


5. WARRANTY

Warranty terms are specified in individual project contracts. General warranty provisions:

  • Workmanship Warranty: A Step Above warrants that all work performed will be free from defects in workmanship for the period specified in the project contract, typically one (1) year from the date of substantial completion.
  • Material Warranty: Materials carry the manufacturer’s warranty. A Step Above does not provide warranties beyond the manufacturer’s stated warranty for materials.
  • Exclusions: Warranty does not cover damage caused by normal wear and tear, misuse, neglect, failure to maintain, unauthorized modifications, settlement, acts of nature, or conditions beyond our control.
  • Claims: Warranty claims must be submitted in writing within the warranty period. We will inspect the claim within a reasonable timeframe and repair or replace defective workmanship at no additional cost.

6. LIMITATION OF LIABILITY

A Step Above’s total liability for any claim arising from a project shall not exceed the total contract value for that project unless otherwise required by law.

We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including but not limited to: weather conditions, natural disasters, pandemics, material shortages or supply chain disruptions, subcontractor delays, permitting delays, utility company schedules, government actions, labor disputes, or client-caused delays.


7. INSURANCE AND COMPLIANCE

A Step Above maintains general liability insurance, workers’ compensation coverage (as applicable), and all licenses required by the State of South Carolina and applicable local jurisdictions. Certificates of insurance are available upon request.

We require all subcontractors to maintain appropriate insurance coverage and provide current certificates of insurance before beginning work on any project.


8. SMS/TEXT MESSAGING TERMS

Consent

By providing your mobile phone number to A Step Above — whether through a signed contract, proposal, direct communication, contractor onboarding, or any other business interaction — you consent to receive business-related SMS/text messages from us.

Types of Messages

Messages may include:

  • Project updates and scheduling notifications
  • Appointment, site visit, and inspection reminders
  • Invoice, proposal, and contract delivery notifications
  • Material delivery and arrival alerts
  • Work assignments and schedule changes (for team members and subcontractors)
  • Safety alerts and compliance notifications
  • Payment confirmations and reminders
  • Warranty and follow-up communications

Message Frequency

Message frequency varies based on project activity. During active project periods, you may receive up to 10 messages per week. Outside of active project periods, message frequency is minimal to none.

Costs

A Step Above does not charge for sending SMS messages. Standard message and data rates from your wireless carrier may apply. Contact your carrier for details about your messaging plan.

Opt-Out

You may stop receiving SMS messages at any time by replying STOP to any message from us. You will receive one final confirmation message. No further messages will be sent unless you re-subscribe.

Opt-In

No Sharing

We do not sell, rent, share, or trade your mobile phone number with any third party for promotional or marketing purposes. Your phone number is used solely for business communications related to your project or engagement with A Step Above.

Supported Carriers

Messages are supported by all major U.S. wireless carriers including AT&T, Verizon, T-Mobile, and others.


9. EMAIL COMMUNICATIONS

We send transactional email communications related to your project including proposals, invoices, contracts, change orders, progress updates, and closeout documentation. These communications are directly related to our business relationship and are not marketing emails.


10. DISPUTE RESOLUTION

Governing Law

These Terms and all project contracts are governed by the laws of the State of South Carolina without regard to conflict of law principles.

Jurisdiction

Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in Horry County, South Carolina. You consent to the personal jurisdiction of these courts.

Mediation

Before initiating litigation, both parties agree to attempt resolution through good-faith negotiation. If negotiation fails, both parties agree to participate in mediation before a mutually agreed-upon mediator in Horry County, South Carolina, with costs shared equally.


11. INDEMNIFICATION

You agree to indemnify and hold harmless A Step Above, its owners, employees, subcontractors, and agents from any claims, damages, losses, liabilities, or expenses (including attorney’s fees) arising from: (a) your breach of these Terms, (b) your misuse of our services or website, or (c) any third-party claims related to information or content you provide to us.


12. PRIVACY

Your use of our services and website is also governed by our Privacy Policy, available at https://astepabovemb.com/privacy-policy-2/. The Privacy Policy describes how we collect, use, and protect your personal information including phone numbers, email addresses, and project data.


13. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.


14. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any executed project contract or proposal, constitute the entire agreement between you and A Step Above regarding the subject matter herein. Individual project contracts supersede these Terms to the extent of any conflict.


15. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of our services or website after changes constitutes acceptance of the updated Terms.
